2. Action Upon Receiving a Valid DMCA Notice

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material (if applicable) of the takedown and provide them with a copy of the notice.
  • Take reasonable steps to prevent further infringement.

We may also terminate the accounts of users who are repeat infringers, in accordance with our policies.

3. Counter-Notification

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated DMCA Agent. Your counter-notification must include:

  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the Northern District of California if your address is outside the U.S.) and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

4. Action Upon Receiving a Valid Counter-Notification

If we receive a valid counter-notification, we will:

  • Provide the original complainant with a copy of the counter-notification.
  • Inform the complainant that we may restore the removed content within 10-14 business days unless we receive notice of a legal action to restrain the content.
  • Restore the content within 10-14 business days if no further action is taken by the complainant.

5. Repeat Infringer Policy

UltraVision Inc. reserves the right to terminate access to the Website or Services for users who are found to be repeat infringers of copyrighted material. We may also take other actions, such as suspending accounts or limiting access to certain features.

6. Misrepresentations
